1) Prima della consegna della bicicletta, dopo aver visionato il mezzo, l'Utente deve presentare documento d'identità valido/passaporto/patente che saranno trattenuti per l’intera durata del noleggio.
2) L'uso della bicicletta presuppone l'idoneità fisica, la maggiore età e la perizia tecnica di chi intende condurla. Per tanto l'utente, noleggiando la bici, dichiara di essere dotato di adeguata capacità e di appropriata competenza, senza porre alcuna riserva. L'utilizzo da parte dei minori è consentito previo consenso scritto da parte del genitore/tutore, il contratto di noleggio dovrà essere controfirmato dal genitore (allegando documento di identità); il genitore con la firma del contratto si assume tutte le responsabilità indicate negli articoli e dal codice civile e autorizza il minore all'utilizzo della bicicletta alle condizioni previste nel presente regolamento.
3) Le biciclette sono da utilizzarsi come mezzo di trasporto ad uso turistico e sono da trattarsi con attenzione; è vietato l’utilizzo ad uso sportivo, il mezzo non può essere ceduto in uso ad altri soggetti; è inoltre vietata l'installazione di qualsiasi accessorio o staffa ad uso privato, se non espressamente autorizzato dal Gestore.
4) L'Utente è responsabile del mezzo fino alla sua restituzione al Gestore, inoltre è responsabile dei danni causati a sé stesso, alla bicicletta, a terzi e alle cose durante l'utilizzo del mezzo. Al Gestore non potrà essere richiesta nessuna forma di indennizzo.
5) Durante il noleggio l'Utente non gode di nessuna forma assicurativa, né la bicicletta è coperta da assicurazione RC. L'Utente è pertanto tenuto a rispettare le norme del Codice della strada. Il Gestore declina ogni forma di responsabilità in caso di utilizzo improprio del mezzo o di mancato rispetto delle norme del codice della strada.
6) Il gestore può effettuare controlli agli Utenti durante l'uso delle biciclette e può richiederne la restituzione immediata se ravvisa il non rispetto delle regole contrattuali o l'utilizzo improprio del veicolo. Il gestore può rifiutare il noleggio a persone in stato di ubriachezza o sotto effetto di sostanze stupefacenti e per altri motivi ad insindacabile giudizio del gestore stesso.
7) In caso di smarrimento delle chiavi o degli accessori della bici e delle attrezzature noleggiate, tutti gli oneri di riparazione saranno a carico dell'Utente, in caso di danni alla bici o alle attrezzature noleggiate tutti gli oneri necessari per i ripristini originali saranno a carico dell'Utente, i preventivi di riparazione verranno forniti direttamente dal gestore. In caso di furto totale l'Utente dovrà risarcire il gestore dell'importo complessivo del valore di listino della bici rubata; i prezzi dei modelli a noleggio sono quelli di listino Mondraker, Merida, Conway e Montana. In caso di furto della bici, l'Utente deve presentare in giornata al Gestore copia della denuncia effettuata presso gli organi competenti e versare contestualmente l'importo pari al valore della bici oggetto del furto; l'importo in caso di ritrovamento verrà restituito, previa verifica dei danni subiti dal mezzo.
8) La bici dovrà essere riconsegnata, nel rispetto degli orari e luoghi presenti nel contratto di noleggio, inoltre la bici va consegnata esclusivamente al gestore e non a terzi, questo per potere effettuare le verifiche di controllo sulla bici e sulle attrezzature. La consegna della bici fuori dall'orario di noleggio, senza autorizzazione concordata verrà sanzionata in base al ritardo e secondo il listino in vigore. La mancata restituzione della bici senza preventiva comunicazione e autorizzazione da parte del gestore, sarà considerata alla stregua di un reato di furto e pertanto denunciato immediatamente all'autorità Giudiziaria competente.
9) L'Utente può chiedere al gestore un intervento per il ritiro della bici, la tempistica di ritiro e il prezzo vanno concordati telefonicamente in base alla disponibilità; l'Utente, fino alla riconsegna della bici, è responsabile del mezzo; il gestore non è tenuto all’intervento, quindi il mancato intervento non può essere causa di inadempimento contrattuale.
10) Il noleggio e l'uso della bicicletta presuppone la conoscenza ed accettazione incondizionata da parte dell'Utente del presente regolamento, delle tariffe e orari di noleggio. Per quanto non citato nel presente regolamento il rapporto tra le Parti (contraenti) è regolato dalle norme del codice civile.
11) Tutti gli atti giuridici sottostanno alla legge nazionale, anche se il locatario ha la propria sede all’estero.
12) Con la prenotazione online il contratto di noleggio è valido a tutti gli effetti alle condizioni indicate.
13) Il Gestore ricorrerà alle vie Giudiziarie nel caso in cui l’Utente comunichi false generalità o domicilio.
1) Before the delivery, the User has to give a valid Identity Document, passport or driving license who will be kept till the end of the rental.
2) The User has to be an adult in good physical shape to use the bike so, renting the bike, he declares to be capable and competent to ride it. The bike can be rented by minors only with the written consent of a parent/guardian, the rental agreement must be countersigned by the parent (attaching an identity document); after the sign of the contract, the parent takes all responsibilities indicated in the articles and the civil code and authorizes the minor to use the bike under the conditions provided in this regulation.
3) The bike is to be used as a tourist vehicle and is to be treated carefully; it is in fact forbidden to use them for race purpose, the vehicle cannot be given to other subjects. It is prohibited the installation of any accessory or bracket for private use if not otherwise said by the Manager.
4) The User is responsible for the vehicle until it is returned to the Manager, he is also responsible for damage caused to himself, to the bicycle, to third parties and to things during rental use. No compensation can be requested from the Manager.
5) The User does not have any form of insurance during the rental and the bicycle is not covered by RC insurance. The User is therefore required to abide to the rules of the traffic laws. The Manager declines all responsibility if the vehicle is not used properly.
6) The Manager can check the bike during the rental and can request its immediate return if the rules in the rental contract are not been followed. The Manager may refuse to rent to people under the influence of or alcohol and for other reasons at his own discretion.
7) If the User loses the keys, accessories or rented equipment, all the costs to buy them new will be charged to the User; in case of damage to the bike or the rented equipment, the cost to bring them back to the original form will be on the User, the price will be provided directly by the Manager. If the bike gets stolen, the User must compensate the Manager for the full price of the bicycle; the prices of the rental models are on the price-list of Mondraker, Merida, Conway and Montana. The User must also provide a copy of the police report of the theft and, at the same time, pay the full amount of the stolen bike. If the bike gets found, the money will be returned to the User after checking the damages suffered by the vehicle.
8) The bike must be returned according with times and places included in the rental contract; the bike must also be delivered exclusively to the Manager and not to third parties, this will help to check bike and equipment. Failing to deliver the bike in time, without authorization, will be charged based on time. Not returning the bike will be considered as stealing and therefore immediately reported to the competent judicial authority.
9) The User can ask the Manager for an intervention for the withdrawal of the bike, time and price must be agreed on the phone based on availability; The User therefore is responsible for the vehicle until the bike is returned; the Manager is not obliged to intervene, therefore failure to intervene cannot result in contractual non-fulfillment.
10) Taking the bike, the User is accepting this regulation. Anything not mentioned in this regulation will abide to the rules of the civil code.
11) These terms and conditions shall abide to the Italian law and submit to the exclusive jurisdiction of the courts of the country, even if the renter has his/her legal residence elsewhere.
12) With the online booking this rental agreement is valid and legally binding.
13) The Manager will take legal actions if the User gives false information.
